END USER LICENSE AGREEMENT
1.1 Governing Agreement
The provisions of this agreement (“Terms of Service”) govern the relationship between you and Gameory Games (“Gameory”, "Gameory Games", “gyg”, "we", "our", or "us") regarding your use of Gameory Games’ games, websites, and related services (“Service”). Use of the Service is also subject to Gameory Games’ Privacy Policy: https://gameorygames.com/privacy-policy.
This Agreement requires disputes to be resolved through individual arbitration rather than jury trials or class actions, and it also limits the remedies available to you in the event of a dispute. Before accessing or using the Service, you must agree to these Terms of Service and the Privacy Policy.
1.2 Updates to Terms of Service and Privacy Policy
Gameory Games reserves the right to modify these Terms and the Privacy Policy at any time. Updated terms will take effect once published on https://gameorygames.com. By continuing to use the Service, you agree to these changes. If you do not agree, your license to use the Service will immediately terminate. In case of conflict, these Terms of Service and the Privacy Policy shall prevail.
1.3 Limited License
As long as you comply with these Terms, Gameory Games grants you a limited, non-transferable, non-sublicensable, revocable license to use the Service solely for personal, non-commercial entertainment purposes. Virtual items (currency, tokens, items, etc.) constitute only a limited license and do not create any real-world ownership rights. Gameory Games reserves the right to modify, update, or discontinue the Service or virtual items at any time. No refunds will be provided for these items in exchange for real money.
1.4 Access to the Service
By accessing the Service, you agree to these Terms. You are responsible for any required devices, software, and internet access fees.
1.5 Use of the Service
Age restrictions for our games are specified on their respective store pages. Users are responsible for complying with platform age restrictions and local laws.
The Service may only be used for personal entertainment purposes; commercial advertising, spam, or unauthorized use is prohibited.
You may not use our Services for any unlawful or unauthorized purpose.
You may not reverse-engineer, decompile, disassemble, or attempt to modify our games or Services.
The following actions are strictly prohibited:
Attempting to disrupt the Service
Reverse-engineering, copying, or distributing source code
Fraudulent, harmful, or abusive activities
1.6 License Restrictions
The user agrees to use the Service only in accordance with these Terms. The following actions are strictly prohibited:
Use of cheats, bots, hacks, or unauthorized software
Attacks against the Service or attempts to disrupt its functionality
Abuse, harassment, threats, or sharing obscene content
Infringement of intellectual property rights (game code, graphics, music, etc.)
If such behavior is detected, Gameory Games reserves the right to immediately revoke the license.
1.7 Termination of Access
In case of violation of these Terms, Gameory Games reserves the right to permanently terminate your license and access to the Service. Gameory Games may partially or completely discontinue or terminate the Service. In such cases, no compensation or refund will be provided.
Users may also stop using the Service at any time by uninstalling the game from their device.
2. OWNERSHIP
2.1 Games and Service
All content within the Service (game code, characters, stories, visuals, sounds, etc.) is owned by Gameory Games.
2.2 Virtual Items
Ownership of virtual items, currency, and in-game content does not belong to the user. All such content is owned by Gameory Games.
2.3 User Content
Gameory Games’ titles do not allow users to upload or share content (text, images, audio, etc.).
Therefore, Gameory Games bears no responsibility for any user content.
Data collected within the Service is processed solely in accordance with the Privacy Policy and may be shared with legal authorities when required.
3. FEES AND PURCHASES
Most Gameory Games titles are free-to-play and generate revenue through advertisements.
Currently, our games do not offer in-app purchases.
In the future, some games may be offered as paid titles or include in-app purchases. Pricing and conditions will be clearly stated on the respective store page in advance.
4. ADVERTISEMENTS
Our games may display advertisements provided by third-party services such as Google AdMob, Unity Ads, or similar providers.
Gameory Games accepts no responsibility for the content, accuracy, or availability of third-party advertisements.
By clicking on an advertisement, you may be redirected to external websites or services. Responsibility for the security and appropriateness of such external content lies with the third party.
5. THIRD-PARTY SERVICES
Our Services may integrate with third-party service providers (advertising, analytics, notifications, etc.).
The use of these third-party services is subject to their own terms of use and privacy policies.
Gameory Games shall not be held liable for the policies or practices of such providers. By using these services, the user agrees to the terms of the respective third parties.
6. SERVICE UPDATES
Gameory Games reserves the right to update, modify, or discontinue the Service or games at any time.
Some updates may be mandatory for continued use of the Service.
Following updates, Gameory Games may restrict, suspend, or remove certain parts of the Service, temporarily or permanently.
7. DISCLAIMERS / LIMITATIONS OF LIABILITY
Warranties: The Service is provided “as is.” No guarantee is given that the Service will be uninterrupted, error-free, compatible with all devices, or fully meet your expectations.
Liability: Gameory Games’ liability is limited to direct damages only and shall not exceed the total fees you have paid for the Service in the last 6 months. Gameory Games shall not be liable for indirect, incidental, special, or consequential damages.
8. INDEMNIFICATION
Users agree that if they violate these Terms or misuse the Service in a way that directly or indirectly causes damage to Gameory Games or third parties, they will bear all legal responsibilities, damages, and expenses, and indemnify Gameory Games.
9. DISPUTE RESOLUTION AND GOVERNING LAW
Disputes should first be addressed through communication with Gameory Games at support@gameorygames.com.
If resolution cannot be achieved, all disputes shall be governed by the laws of the Republic of Turkey.
The parties agree that the Courts and Enforcement Offices of Ankara shall have jurisdiction over any disputes that may arise.
10. SEVERABILITY
If any provision of these Terms is found invalid, void, or unenforceable, this shall not affect the validity or enforceability of the remaining provisions.
Any invalid provision shall be replaced by a valid one that most closely reflects the original intent of the parties.
11. GENERAL PROVISIONS
Assignment: Gameory Games may assign its rights. You may not assign yours.
Additional Policies: Additional rules may apply to contests, events, or campaigns.
Entire Agreement: This agreement supersedes all prior written or oral agreements between the parties.
Waiver: Failure to exercise a right does not constitute a waiver of that right.
Notices: Gameory Games may provide notices via website or email. You may also send written notices to the official address.
Equitable Relief: In the event of a breach, Gameory Games may seek injunctive relief in addition to monetary damages.
Force Majeure: Gameory Games shall not be liable for service interruptions or failures caused by natural disasters, war, terrorism, fire, flood, strikes, power or internet outages, or other events beyond its control.
